Activision has been sued in a lawsuit alleging the publisher stole artwork and design for a character used in Call of Duty: Modern Warfare.

The legal filing, first reported by TorrentFreak, claims that Activision copied a character known as Cade Janus from a short story written by the actor, Clayton Haugen.

The author had previously hired streamer Alex Zedra for a photo shoot as part of an effort to purchase the story in film studios. Haugen says Activision later used the same model and even bought the same makeup artist to scan his likeness directly in Call of Duty: Modern Warfare.

The lawsuit claims the company did this to directly copy Cade Janus’s design from Haugen’s “November Renaissance” to create the character of Mara. This figure was therefore widely present in the game and promotional material.

The lawsuit was filed in a Texas court and states that Haugen is seeking to “recover all monetary remedies from Defendants’ violation, including all their profits attributable to their violations, to the fullest extent permitted by 17 USC § 504.”

The plaintiff requests that the case be submitted to a jury.
